Employers can always voluntarily agree to collectively bargain, but if they do not, under section 237 the Fair Work Commission can require good faith bargaining after determining that there is majority support, "using any method the FWC considers appropriate", such as petitions, pledge cards, union lists, or in rare cases a ballot.
